How do auctions work in Italy and why do we only follow them in the Fermo province area?

When a person (the “debtor”) fails to pay their debts – usually to a bank or other creditor – the court can sell their assets, such as houses, apartments, or other properties, to recover the money owed.


Step-by-Step Process

  1. Property Valuation
    The court appoints an expert to estimate the property’s market value.

  2. Auction Publication
    A professional (often a lawyer or accountant) publishes the auction on official websites and the Ministry of Justice’s portal.

  3. Advertising Period
    The auction is advertised for about 90–120 days. You can submit an offer at least 25% below the starting price.
    Example: If a property is valued at €100,000, you can offer from €75,000, paying a deposit equal to 10% of your bid.

  4. Auction Day (Fully Online)

    • If there’s only one bidder, they win the property.

    • If there are multiple bidders, they can increase bids by at least €1,000 until the auction closes (it lasts two days).

  5. Unsold Auctions
    If no one bids, the court schedules a new auction with an extra 25% reduction in the minimum bid. This process can repeat several times, allowing some properties to be purchased at very attractive prices.
